Suspension and the non-striking worker

Section 128 of the Industrial Relations Act 1973 allows an employer to suspend nonstriking workers where work normally performed by them is not available because of a strike. This article considers the background to, and the case law arising from, such suspensions and the limitations that have been established on the employers power to suspend such workers.Downloads
