Abstract

This article discusses fisheries matters in the wider context of Māori people's endeavour as well as the prosecution and negotiation of claims under the Treaty of Waitangi. The first part of the article takes a general view of the parameters of the search for insights on fisheries. The second part of the article takes a more detailed view in the form of a case study, following certain aspects of the Te Ohu Kai Moana experience in traversing the continuum of effecting robust settlement results. The author concludes by advocating for minimum government or centralised intervention in the management of resources, calling for the whole dispute resolution process to be addressed from a strategic point of view and some rationalisations made so that the people concerned have an expeditious, efficient, and affordable process that takes account of the nature of the issues and the participants.
